Proposed Changes to the K1 Fiancee Visa

 

 

H.R. 2949, Introduced on July 25 by Representative Rick Larsen (D-WA), the International Marriage Broker Regulation Act of 2003 would regulate international marriage broker activity in the United States. It would provide certain protections to individuals who utilize the services of international marriage brokers.

 

Section 2 of H.R. 2949 would amend INA §214(d) to provide that a U.S. citizen or legal permanent resident may not file more than one application for a fiancé(e) visa in any one-year period. Section 5 of the bill requires consular officers to disclose to applicants for a fiancé(e) visa information discussing the illegality of domestic violence in the U.S. Officers would also inform applicants of the availability of resources for victims of such violence and their right to self-petition for permanent resident status under the Violence Against Women Act. 

 

U.S. petitioners would also be required to undergo a background check relating to previous convictions for, or acts of, domestic violence, abuse or neglect. Such information would be made available to K-1 applicants.
