K-1 Processing in India

 

All applicants must submit certain personal documents such as passports, birth certificates, police certificates, and other civil documents, and evidence that they will not become public charges in the U.S. at the time of applying for a visa. The applicants will be informed of other documents needed as the applications are processed, and each will receive a "Packet Four- Information for Immigrant Visa Applicants" containing details on all the requirements for Immigrant visa processing. Every applicant, regardless of age, must undergo a medical examination by a doctor designated by the U.S. Embassy before the issuance of an immigrant visa.

 

After the Embassy has received the approved visa petition from the BCIS according you status as a fiancé or fiancée you will receive a letter from the Embassy instructing you to appear for your visa interview. When you come to the Embassy for your interview, please bring the documents listed below with you.

 

Please read the instructions below and follow them carefully:

bulletComplete the OF-179 Biographic Data form, available from the Embassy at no charge.

bulletComplete two copies of form DS-156, and one copy of DS-156K, the supplemental form to the DS-156 for nonimmigrant fiancé/fiancée visa applications. Do not sign the supplemental form.



Please assemble the following documents for presentation at your visa interview:
bulletA valid passport

bulletA birth certificate: Copy of your official birth certificate issued by the Registrar of Births

bulletEvidence of relationship: You will be asked for evidence that you have met your fiancé or fiancée, and for proof of a valid engagement. Bring letters, photographs, or other evidence of your relationship.

bulletA completed Affidavit of Support form and supporting documents from your sponsor

bulletProof of the legal termination of any previous marriage: death certificate of spouse, or decree of divorce or annulment

bulletPhotographs

bulletCourt and prison records: If you have been convicted of a crime or other offense, obtain a certified court record covering each offense.

bulletStatement concerning your intent to enter into a valid marriage with your fiancé/fiancée within 90 days of your admission into the U.S. Complete but do not sign this statement.

bulletMedical: Obtain a medical examination from one of the Embassy’s panel physicians

bulletIf you were previously married and have minor children who wish to accompany you to the United States, present one certified copy of each child’s birth certificate.

bulletPolice Certificate: Each visa applicant over the age of 16 must present Indian police certificates as follows: one certificate from the applicant’s local police station and one certificate from the applicant’s regional passport office.  Applicants are also required to submit police certificates from the police authorities in each country other than India and the U.S. in which he or she has resided for at least six months after the age of 16.  A police certificate must also be obtained from the police authorities of any place where the applicant has been arrested for any reason, regardless of how long he or she lived there.  Police certificates from certain countries are considered unobtainable.  The consular officer will advise you about any particular country.
